Terms & Conditions

These terms apply to every quote we give and every order you place with AM:PM Marketing Ltd (ABN 58 607 202 146), trading as AM:PM Promo. Please read them before ordering — placing an order means you accept them.

1. Quotes and pricing

  • Quotes are valid for 30 days from the date issued unless the quote says otherwise.
  • Quotes are based on the quantity, product, colours and decoration specified. Changing any of these changes the price.
  • All prices are in Australian dollars and exclude GST unless stated otherwise. GST is shown separately at checkout.
  • Prices exclude freight unless the quote expressly includes it.
  • Our prices depend on supplier pricing, stock and exchange rates. We may adjust a quoted price before you accept it, or where a supplier increases its price before your order goes into production. If that happens we will tell you before proceeding, and you may cancel without charge.

2. Orders

An order is accepted only when we confirm it in writing and, where payment is required up front, payment has been received. We may decline an order — for example where stock is unavailable, artwork cannot be reproduced, or the requested decoration would infringe someone else's rights.

3. Artwork and proofs

  1. You must supply artwork in a usable format. Vector files (AI, EPS, PDF) reproduce best. We may charge for redrawing or converting unusable artwork, and we will quote that before doing it.
  2. You warrant that you own or are licensed to use any logo, image, trade mark or text you supply, and that its use does not infringe anyone else's rights. You indemnify us against any claim arising from artwork you supply.
  3. We will send you a digital proof for approval before production begins. Check it carefully — spelling, colours, sizes, quantities and placement.
  4. Your written approval of the proof is final. Once approved, we produce to that proof, and errors carried through from an approved proof are not our responsibility.
  5. Production time starts from the date you approve the proof, not the date you place the order.

4. Colour

Colours shown on a screen are a guide only and will not match a printed or decorated product exactly. Where you specify a PMS colour we will match it as closely as the decoration process and the material allow, but an exact match cannot be guaranteed — particularly on coloured, textured or non-paper substrates. Slight colour variation between production runs, and between different items in the same order, is normal and is not a defect.

5. Quantity tolerance

Decorated production runs can vary slightly. We may supply and invoice up to 5% over or under the ordered quantity, charged at the quoted unit price. If you need an exact quantity, tell us before production and we will produce to guarantee the minimum.

6. Production and lead times

Lead times quoted are estimates in business days and run from artwork approval. They depend on stock availability, decoration method and freight. We will always tell you promptly if a lead time changes. We are not liable for loss caused by a delay outside our reasonable control, including supplier stock-outs, freight delays, industrial action or events beyond our control. If you have a fixed in-hand date, tell us before you order so we can confirm whether it is achievable.

7. Payment

  • Unless we have agreed account terms with you in writing, full payment is required before production begins.
  • We accept the payment methods shown at checkout. Card payments are processed securely by Stripe.
  • Where account terms apply, invoices are due 30 days from the date of invoice.
  • Title in the goods stays with us until we have been paid in full. Risk passes to you on delivery.

8. Delivery

9. Changes and cancellation

  • You may change or cancel an order at no charge at any time before you approve the proof, other than any artwork or setup work already carried out.
  • Once you approve the proof, the order cannot be cancelled — stock has been allocated and decoration has been scheduled. If you cancel after approval you remain liable for the full order value, or for the costs we have already incurred, whichever is lower.
  • Changes requested after approval may incur additional setup, restocking or freight charges, which we will quote before proceeding.

10. Returns

Custom-decorated goods are made to your specification and cannot be returned for change of mind. Your rights where something is wrong with an order are set out in our Returns & Refunds page, which forms part of these terms and does not limit your rights under the Australian Consumer Law.

11. Our liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot lawfully be excluded. Where we are permitted to limit our liability, our liability for any claim is limited, at our option, to replacing the goods, resupplying the decoration, or refunding the price you paid for the goods in question. We are not liable for indirect or consequential loss, including loss of profit, loss of opportunity, or costs arising from a missed event or campaign date.

12. Intellectual property

You keep ownership of your artwork and trade marks. We keep ownership of any origination, layout, separation or die we produce. Unless you tell us in writing not to, we may photograph finished work and use those images to promote our services.

13. Privacy

We handle your personal information in accordance with our Privacy Policy.

14. Governing law

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of that State.
